These Terms of Service ("Terms") govern your access to and use of the TriSend application ("App", "Service") provided by TriSend ("we", "us", "our"). By installing the App from the Shopify App Store, you agree to be bound by these Terms.
By installing, accessing, or using TriSend, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must uninstall the App immediately. These Terms apply in addition to Shopify's Terms of Service and any other agreements you have with Shopify.
TriSend is a multi-channel marketing platform for Shopify merchants. The Service provides:
You must have an active Shopify store to use TriSend. You are responsible for maintaining the security of your Shopify account. You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
TriSend offers Free, Starter, Growth, and Pro subscription tiers. All paid plans are billed through Shopify's Billing API as recurring monthly charges. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your payment method on file.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use policies.
You are solely responsible for ensuring that your marketing messages comply with all applicable laws and regulations in the jurisdictions where your recipients are located. This includes but is not limited to:
Your use of TriSend is also governed by our Privacy Policy. We process customer data on your behalf as a data processor. You remain the data controller and are responsible for ensuring you have a lawful basis for processing your customers' personal data through our Service.
TriSend and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all content you create or upload through the Service, including campaign content, templates, and customer data.
TriSend integrates with third-party services including AWS SES, Twilio, and Meta Business API. Your use of these services through TriSend is subject to their respective terms of service. We are not responsible for the availability, performance, or policies of third-party services.
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or security patches. We will make reasonable efforts to provide advance notice of planned downtime.
To the maximum extent permitted by law, TriSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that message delivery rates will meet any particular threshold.
You agree to indemnify, defend, and hold harmless TriSend and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
You may terminate your use of TriSend at any time by uninstalling the App from your Shopify store. We may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your data will be handled in accordance with our Privacy Policy and Shopify's mandatory data deletion requirements.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, sending a notification through the App. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TriSend operates, without regard to conflict of law principles.
